TERMS & CONDITIONS
Let's be honest, no one reads Terms & Conditions. I typically don't either. π€·ββοΈ
That said, in this instance they're here for a good reason. They protect my work and intellectual property while also giving you a clear understanding of what to expect and how you can use the images from our shoot.
Most of what's covered below is straightforward, but there are a few important points I'd like you to understand before booking. Taking a couple of minutes to read through these terms now helps ensure we're on the same page and avoids any misunderstandings later.

Booking & Payment:
Full payment is required to confirm your booking. Your date isn't secured until payment is received.
Your Responsibilities:
Please provide accurate details about your shoot (location, timing, access) ahead of time.
If a location needs special permission or access (private property, closed roads, venues, etc.), that's the client's responsibility to arrange unless agreed otherwise.
Privacy:
Your personal details are only used to deliver your booking and are handled in line with the Privacy Act 1988 (Cth).
Your information is never sold or shared, except where necessary to provide the service (e.g. a printing lab).

Cancellations of any kind incur an admin fee to cover the time spent organising your session β this helps cover the work already put in if a shoot doesn't go ahead.
Why the fee: While costs like travel aren't incurred once a shoot is cancelled, your booked slot still takes up availability that could have gone to another client, and the running costs of the business (website, booking, and gallery software) continue regardless. Admin fees help cover this lost time.
CANCELLATION FEES BY NOTICE GIVEN:
More than 7 days notice: 10% admin fee
Within 7 days: 25% admin fee
Within 48 hours: 50% admin fee
Within 24 hours: non-refundable
Rescheduling instead of cancelling? You'll get half that fee back as a credit toward your new date (5%, 12.5%, 25%, or 50% depending on your notice period).

Edited photos are typically delivered within 1β2 business days via an online gallery. As this is run alongside a full-time job, turnaround can occasionally take longer depending on workload β you'll be kept informed if so. Rush delivery is available for an additional fee if you need photos sooner - please talk to me about this option ASAP during the booking process if you require this service.
Raw/unedited files are not provided under any circumstances - only final edited images will be supplied to protect my IP, artistic decisions and image.

You're free to use your delivered photos for both personal and promotional/marketing purposes. This being said, there are some conditions to this:
Loftes Photography retains copyright over all images. Heavily altering images (filters, AI editing, etc) without prior permission is against the copyright of my IP and is not allowed without approval or prior discussion. And letβs be honest - if you really just want the image to be altered (black and white, colour temperature changes ETC) then just talk to me! I am more than happy to accommodate for some small changes on a couple photos to better fit a specific use case, however my artistic view needs to be respected for the majority of the shoot.

If you wish to use images from your session for commercial in such a manner that they are sold or used on products/services to be sold this must be discussed during the booking process as royalties will be applied (royalty cost is decided on at a case by case scenario depending on the size of your business/brand and scope of product production volume/sales)
If you later wish to use images from one of our shoots for commercial purposes then please just reach out and we can discuss a fair royalty percentage to support my work.

Photos from your session may be used on Loftes Photography's website, marketing material, and social media to showcase new work.
If you'd prefer your photos stay private, just let me know before your shoot and I'll accommodate this. My preference is always to share at least a few images from each session so if we can agree on specific photos that are okay to use, that's fantastic. But if you'd rather none be used at all, I'll respect that decision entirely.

Liability is limited to the amount paid for the session. While every care is taken, Loftes Photography isn't responsible for loss of images due to equipment failure or events outside reasonable control (severe weather, venue restrictions, etc.).
Photos are edited in a style consistent with the portfolio and work shown prior to booking. As this style may include creative choices around tone, focus, lighting, and editing, personal preference about the artistic outcome doesn't constitute a fault or service issue. Any concerns about missing deliverables or technical quality should be raised as soon as possible so they can be addressed directly.
Reasonable precautions are taken to protect your images, including on-the-day backups where possible. However, in the rare event of data loss or corruption, Loftes Photography's liability is limited to a refund of fees paid for the affected session. this can't extend to the personal or sentimental value of lost images, particularly for one-off events like weddings. If capturing irreplaceable moments is critical, engaging an additional photographer for redundancy is strongly recommended.
Nothing in these terms overrides your rights under the Australian Consumer Law.
